In a significant development in the ongoing conflict between technology companies and European regulators, Meta Platforms has exempted Italy from its intended ban on competing chatbots on WhatsApp, acting in response to an order from the Italian Antitrust Authority (AGCM).


According to an official communication from Meta to AI technology providers and developers, which was reviewed by Reuters, phone numbers registered with the Italian country code will not be affected by the updated WhatsApp terms of service at this time, aligning with the directives of the Italian regulatory body.


The original ban was scheduled to take effect on January 15, 2026, which would have barred AI-powered chatbots from other companies from functioning on WhatsApp, thereby favoring Meta's integrated smart assistant, Meta AI, introduced last year.


* European Investigations and Legal Pressures

This situation arose after the Italian Competition Authority mandated Meta last month to temporarily halt the enforcement of the ban while investigations into potential market dominance abuse are underway, following complaints from competing firms.


Simultaneously, the European Commission is conducting a separate inquiry into Meta to assess whether the company has breached competition laws by limiting access for rival chatbots on WhatsApp, though no temporary measures have been imposed against the company as of now.


* Meta's Position and Competitor Reactions

Despite the rising controversy, Meta has not directly addressed the updated terms of service, instead referencing a prior statement from late last year that indicated the proliferation of chatbots had significantly strained WhatsApp's infrastructure, which was not originally designed for such extensive usage.


Conversely, Interaction Company of California, the developer of the smart assistant Poke.com—one of the firms that lodged complaints with the Italian and European competition authorities—strongly criticized Meta's decision to exempt only Italy, labeling it as inequitable and raising concerns about fair competition within the European market.


* Implications of the Decision

Exempting Italy from the ban introduces a new phase in the ongoing struggle between major tech firms and independent AI developers, highlighting the vigilance of European regulators in monitoring practices that may enhance monopolistic behavior or undermine competition in an expanding market.


As the implementation date for the new WhatsApp terms approaches, attention remains focused on Brussels and Rome to determine whether Italy will stand as the sole exception or if regulatory pressures will compel Meta to revise its strategy across Europe.
